If she did not approve of the pic being there, she has possible grounds for defamation or another charge, ESPECIALLY if it was an amateur nude photo to which the IP belonged to the plaintiff. I wasn't here, so I don't know the story. But let's say someone put a nude or compromising picture up of you on a website, Carina, WITHOUT your permission, and you were unhappy about it. Then you asked to take it down, and they didn't. You really think you'd have no legal recourse? |

It's true, it's a big gray area...but hell, even Google has had successful injunctions filed against them for the nude photos. All depends on the individual situation I guess. But considering that people can now be sued for harassment on the internet, they can definitely be sued for misuse of nude photos (which often tie hand in hand with harassment), make no mistake about it. |
